CONDITIONS OF USE OF AKTEOS ACADEMY

Preamble

Akteos Academy is the Learning Management System (LMS) of Akteos and offers modules and training programs in Digital Learning or Blended-Learning.

In accordance with article 6-III-1 of law 2004-575 (June 21, 2004) calling for the confidence in the digital economy, you are informed of the following points:

Article 1: Purpose

The purpose of these general conditions is to establish the rules of use of the platform by the users, as well as Akteos’ commitments. These conditions are intended to ensure a high level of quality of service.

By connecting to Akteos Academy and using the tools available on the site, the user acknowledges having read and understood the general conditions of use of Akteos Academy, and agrees to be bound by its provisions and to comply with them under penalty of being excluded without notice.

When requesting the registration of an employee, the company accepts the general conditions of use. If the company wishes to have a report on the activities of its employees, the company agrees to inform its employees.

Article 2: Registration

The login credentials to connect to Akteos Academy are sent by e-mail to the user at the time of registration. These identifiers are personal and confidential. In the case of change of e-mail address, loss or theft of his password, the user must contact Akteos.

Article 3: Compliance with Current Legislation

The user is obligated to obey the legislation of French territories. Specifically, this concerns compliance with copyright, trademark law, database law and, more generally, all the rights outlined by the Intellectual Property Code. The user is also required to comply with the provisions of the law of July 29, 1881 concerning freedom of the press and, in particular, Chapter IV dedicated to offences as regards the press. Consequently, the user undertakes not to disseminate any message:

  • contrary to public order and morality;
  • violating the intellectual property rights of third parties;
  • insulting or prejudicial to the honor, consideration and/or the dignity of any person;
  • inciting racial hatred, discrimination or the commission of a pornographic or pedophilic offence;
  • violating personal rights, such as privacy;
  • contrary to the laws and regulations relating to advertising activities;
  • and, more generally, no message in possible contradiction to French legislation.

Article 4: Penalties

In case of non-compliance with Article 3 of these Terms of Use, Akteos reserves the right to:

  • delete the litigious message without notice;
  • deny the user access without notice;
  • inform the police and judicial authorities.

The same sanctions may be applied in case of verbal aggression, vulgarity, repeated provocation and, more generally, any behavior contrary to the rules and customs of the Internet, known as ‘netiquette’. The user's attention is drawn in particular to the fact that his or her comments engage, regardless, his or her responsibility.

Article 5: Internet Usage Rules

All users of the LMS formally recognize the characteristics and limitations of the Internet, and, more precisely, recognize:

  • that they are solely responsible for the use they make of the information on the site;
  • that they are solely responsible for the use of the content of the sites to which the site contains a hypertext link;
  • that the communication of their personal identification information and, in general, of any information judged by them as sensitive or confidential, is made at their own risk and peril;
  • that they are aware of the nature of the Internet and, particularly, of its technical performance and response times for consulting, querying and/or transferring information.

Article 6: Exemption from Liability

Akteos is not responsible for malfunctions of the Internet network.

Akteos does not assume any responsibility for the messages posted by users and declines any responsibility for their content.

Akteos cannot give any guarantee regarding the information provided by third parties, nor regarding the content of websites accessible by hypertext links.

Akteos does not guarantee the use of this information and cannot be held responsible for any prejudice or damage that may result from the use of this information.

Article 7: Intellectual Property Rights

By accessing the site, Akteos grants to the user a license that does not include the transfer of any property rights of the information contained on the site to the user.

The license confers to the user the right of private use of the information consulted. This individual right is reserved for the exclusive and non-collective use of the user. It is not transferable in any way. Any networking, any redistribution in any form, even partial, is prohibited. Violation of these mandatory provisions exposes the offender and any person responsible for it to the civil and penal penalties outlined in French law.

Article 8: Personal Data, Security and Confidentiality

The users have identification credentials and an access code which are strictly personal. These identification elements are strictly reserved for their own personal use. Users will do their utmost to keep them secret and not to disclose them in any form whatsoever.

In accordance with the General Data Protection Regulation (EU Regulation 2016/679), adopted on April 14, 2016, promulgated on April 27, 2016, which came into force on May 25, 2018 in European countries, Akteos has put in place rules in order to guarantee the rights to personal data, such as the right to information, the right to challenge a decision taken on the basis of automated processes, the right of access to the data, the right of rectification of the data in case of change, the right of deletion in the absence of a legitimate reason for conservation, the right of portability, the right of opposition to the treatment in the absence of legitimacy of the treatment or commercial prospecting, and the right of limitation in the case of illegal treatment.

Akteos collects in a fair and transparent way the personal data of the users and is committed, within the framework of its activities and in accordance with active legislation, to ensure their protection, confidentiality and security.

Akteos implements security measures in accordance with the degree of the sensitivity of personal data, and protects them against any malicious intrusion, loss, alteration or disclosure to unauthorized third parties, and guarantees the security of the information provided and the respect of their privacy.

Akteos uses the personal data of the users to authenticate the users, to provide them with the subscribed service and to bring them a relevant support in their intercultural professional issues. The questionnaires filled in and the data collected on this space are only visible by the user and Akteos. Only the comments are visible to all users.

Subject to any legal or accounting requirements, personal information is kept only as long as necessary to achieve the purposes for which it was collected. Personal information that is no longer required is destroyed, erased or made anonymous.

The users have the right to withdraw their consent to the collection and processing of their data by Akteos at any time by requesting the closure of their account and the deletion of their personal data at Akteos, 2 bis, rue Descombes, 75017 PARIS or by email at academy@akteos.com.

Article 9: Complaints

Complaints relating to the conditions of use by Akteos Academy can be made either by email to academy@akteos.com or in writing to Akteos, 2 bis, rue Descombes, 75017 PARIS.

Article 10: Modifications

The online terms and conditions of use supersede the printed terms and conditions.

The parties have agreed that Akteos can modify the services without any process other than including these modifications in the General Terms and Conditions online, according to the evolution of the network, new services and the services put online.

Article 11: Acceptance

The Akteos Academy user acknowledges having read the present general conditions of use and declares to accept them without reservation.
